1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Agreement" — these Terms and Conditions together with any written service quotation or condition report accepted by the Client.
- "Service" — watch repair, overhaul, crystal renewal, gasket work, bracelet fitting or any other horological work carried out by Detik Warisan.
- "Client" or "you" — any individual who brings a timepiece to the workshop or submits an enquiry through the website.
- "We", "us", "our" — Detik Warisan, 27 Jalan Sultan Ismail, 50250 Kuala Lumpur, Malaysia.
- "Piece" — the watch or timepiece left with us for assessment or service.
- "Condition Report" — the written assessment of the piece's condition and proposed scope of work provided to the Client before any service begins.
2. Acceptance of Terms
By submitting an enquiry through this website, leaving a piece with us for inspection, or approving a Condition Report, you agree to be bound by these Terms. You confirm that you are at least 18 years of age and have the legal capacity to enter a binding agreement. If you are bringing in a piece on behalf of another person, you confirm that you have authority to do so and accept these Terms on their behalf.
3. Service Description
We offer three primary categories of service: full movement overhaul, crystal and gasket renewal, and bracelet and strap fitting. Details of each service, including indicative pricing, are available on our website and in the Condition Report issued for each job.
Services are performed at our workshop in Kuala Lumpur, Malaysia. We do not offer postal or courier service at this time. Clients must collect their piece in person or arrange authorised collection.
4. Service Intake and Condition Report
No service work begins without a Condition Report having been issued and approved by you. The Condition Report sets out: the condition of the piece as received, the proposed scope of work, an estimate of costs (parts listed separately where applicable), and an estimated turnaround time.
Approval of the Condition Report constitutes instruction to proceed. If you decline to proceed after receiving the report, no charge is made for the inspection and the piece is returned as received. We reserve the right to decline work on any piece without being required to give a reason.
5. Payment Terms
All prices are quoted and payable in Malaysian Ringgit (RM). Payment is due in full upon collection of the piece. We accept cash and bank transfer. We do not accept payment by credit or debit card at this time.
If additional parts are required during the course of service that were not identified at the Condition Report stage, we will contact you before fitting them and obtain your approval. No additional charges are applied without your express agreement.
If a piece is not collected within sixty days of notification that the work is complete, we reserve the right to charge a storage fee of RM 10 per week from day sixty-one onwards.
6. Turnaround Times
Estimated turnaround times provided at intake are indicative. They may be extended if a part requires sourcing, if additional work is identified and approved, or in circumstances beyond our reasonable control. We will contact you before any change to the estimated completion date.
We do not accept liability for losses arising from delays in the completion of service, including losses arising from a watch being unavailable for use or for a specific occasion.
7. Piece Left in Our Care
Pieces left with us for inspection or service are held in our care and are not available for return during active service work. We take reasonable precautions against loss, theft and accidental damage while a piece is on our premises.
We recommend that clients hold insurance cover for their timepieces independently of any assumption that cover exists while the piece is in our workshop. We do not insure client pieces against loss or damage beyond what our professional duty of care requires.
You warrant that you are the legal owner of the piece or have authority from the owner to bring it in for service. We may request proof of ownership for high-value items at our discretion.
8. Warranties and Disclaimers
We carry out service work to a professional standard using appropriate methods and materials. We do not warrant that a specific rate accuracy or performance result will be achieved, as this depends on the condition and inherent characteristics of each movement.
We will advise you at the Condition Report stage if a piece's condition makes a satisfactory outcome uncertain. Any such advice does not constitute a refusal to proceed — the decision is yours.
This website and its content are provided "as is". We make no representation that the information on this website is complete, current or free from error.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, our total liability to you for any claim arising from the service or from use of this website is limited to the amount paid by you for the specific service in question. We are not liable for indirect, consequential or special losses, including loss of use, loss of value or sentimental loss associated with a timepiece.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
10. Intellectual Property
All content on this website — including text, images and design — is the property of Detik Warisan or used with appropriate permission. You may view and print content for personal, non-commercial reference purposes. You may not reproduce, distribute or commercially use any content without our prior written consent.
11. Indemnification
You agree to indemnify and hold harmless Detik Warisan and its personnel from any claim, loss or expense (including legal costs) arising from your breach of these Terms, your misrepresentation of ownership of a piece, or your misuse of this website.
12. Termination
Either party may terminate a service arrangement before work begins. If you withdraw approval for a Condition Report before the work has started, no charge is made. If you withdraw approval after work has started, we reserve the right to charge for work completed to that point.
We reserve the right to cease providing services to any individual, including declining future intake, where there is a history of non-payment or conduct that we consider inappropriate.
13. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute arising from a service engagement, we ask that you contact us in the first instance at [email protected] to attempt resolution informally. If the matter cannot be resolved through direct communication, it will be subject to the jurisdiction of the courts of Kuala Lumpur.
Clients may also seek recourse through the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) for matters falling within that body's jurisdiction.
14. General Provisions
Entire Agreement: These Terms, together with any Condition Report you have approved, constitute the entire agreement between us and supersede any prior discussion.
Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect.
No Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce it later.
Assignment: We may assign our rights and obligations under these Terms without notice. You may not assign your rights under these Terms without our written consent.
15. Changes to These Terms
We may update these Terms from time to time. Changes will be reflected in the date at the top of this page. Continued use of our website or services after an update constitutes acceptance of the revised Terms. Material changes will be noted on the website for thirty days following the update.
